Booking Terms & Conditions

PLEASE READ THIS DOCUMENT CAREFULLY. WHEN YOU MAKE A RESERVATION WITH US (WHETHER BY EMAIL, TELEPHONE OR ONLINE), THESE CONDITIONS ARE DEEMED TO HAVE BEEN ACCEPTED BY YOU.

1 Welcome

1.1 These terms and conditions ("Booking Conditions") apply to any reservation you make with us for a holiday property at Emmetts on Exmoor (each a "Booking"), whether by telephone, email or via the website.

1.2 Please read these Booking Conditions carefully before you confirm your booking as these terms and conditions will apply when doing so. We recommend that you print or save a copy of these Booking Conditions for your reference. By making any booking with us, you confirm that you accept these terms and conditions and agree to comply with them.

2 Privacy Policy

2.1 We take your privacy very seriously. We collect the minimum amount of data possible via an online form which you are directed to in order to book. We may from time to time send customers marketing emails if they have consented for us to do so.

3 Literature

3.1 We make every effort to ensure that the property descriptions are accurate and complete. All information on our website, third party websites and that given in emails or over the telephone is given in good faith and is believed to be correct at the time of going to press. These descriptions include details of the property including photos, the availability period of the property for rental, the rental charges and any additional charges and the facilities available at the property.

4 Contract of Hire

4.1 The hiring contract will be between you the ‘Hirer’ and the ‘Owner’ of the property for which the booking is made and shall be deemed to be made subject to the Booking Conditions and governed by English law. The contract is for the hire of the property for holiday purposes only.

4.2 Under no circumstances may more than the maximum number of persons occupy the property. Single sex parties of over six people must be advised to Emmetts on Exmoor at the time of booking.

4.3 To be eligible to make a booking and enter into a rental contract you must:

Be 18 years of age or over;

Complete the online booking form using your real name, phone number, email address and other requested information; and

Possess a valid payment method such as a valid debit or credit card or PayPal account.

5 Initial Payment

5.1 Bookings will be confirmed upon receipt by Emmetts on Exmoor of the required 30% deposit payment. However, if the booking is made within six weeks of the holiday commencement date, the full accommodation rental sum will be required.

6 Balance Payment

6.1 Balance payments are due six weeks before arrival. Invoices will be sent out a minimum of seven weeks before arrival. If a balance is overdue, we will endeavour to contact you. If not contact is made we will cancel the booking and release the dates.

7 Security Deposit

7.1 All bookings are subject to a refundable £300 security deposit. The security deposit must be paid alongside the balance payment and is similarly due six weeks before arrival. The security deposit will be returned to you within 14 days of the end of the booking period. If we retain any part of the security deposit, you will be notified in writing of the reasons for doing so.

8 Value Added Tax

8.1 Where VAT applies to the property rental, it is included in the quoted price at the prevailing rate, ie. 20%. All VAT inclusive property rentals are subject to change if the rate changes.

9 Booking Cancellation by the Hirer

9.1 Please check all the details in your booking confirmation promptly after receiving the confirmation and notify us as soon as possible if you think we have made any mistakes or errors with your booking.

9.2 The hirer is strongly recommended to take out holiday cancellation insurance.

9.3 If you need to cancel your holiday, please inform Emmetts on Exmoor in writing as soon as possible. This will allow us to trey and maximise the amount you may be refunded.

9.4 If you cancel your holiday, we will try and re-let the property for the dates you had booked. If we are able to obtain the full price for the relevant dates, we will refund you any monies paid less £50. If we are unable to obtain full price for the relevant dates, we will refund you any monies paid minus £50 plus the difference in booking value. If we are unable to re-let the relevant dates, you will not receive a refund.

9.5 Your holiday is non-transferable. Should you be unable to take your holiday but have a friend or family party who would like to take your place, this must be arranged and confirmed in writing in advance.

10 Booking Cancellation by Emmetts on Exmoor

10.1 We reserve the right to refuse admittance or eject customers if these conditions are not observed.

10.2 We reserve the right to refuse or revoke any bookings from parties that may, in our opinion and at our sole discretion, be unsuitable for the property.

11 Your responsibilities

11.1 You are responsible for the property and must take all reasonable care of it during your stay. You will (and will ensure that your guests will) show all due consideration and respect for us and our neighbours or other persons or parties that have a connection with the property;

11.2 You will allow us or our representative to access the property at any reasonable time during your stay in the case of emergency;

11.3 The property and all furniture, utensils, equipment, fixtures and fittings, etc. in or on the property must be left clean and in the same state of repair and condition as at the commencement of your stay;

11.4 Pets must not be left unattended in the property at any time and must not be allowed to climb or sit on the furniture. Pets are not allowed in the bedrooms under any circumstances. All traces (inside and outside) of pet occupation must be removed before you vacate the property. You must notify us at the time of booking if you intend to bring a pet/s. A nominal fee applies.

11.5 All damages and breakages must be notified to us before the end of your holiday. A proportion of your security deposit may be retained to cover the cost of additional cleaning or to replace broken items

11.6 There must be no smoking within the property under any circumstance;

11.6 Arrivals are from 4pm onwards and your departure must take place before 10am;

11.7 You must not allow any person other than you and your guests to use the facilities and amenities of the property without the express permission of the owner. If additional persons do visit the property, you are liable for their actions and any resultant damages;

11.8 You must notify all guests before the holiday period starts of their obligations;

11.9 In the event that you or any guest fails to comply with the requirements set out above in paragraphs, we may refuse to allow you and your guests to enter and stay at the property or may require you and your guests to leave the property before the end of the holiday period. In either case, we will not be liable to make a refund of any remaining portion of the hire terms paid.

Legal

In the event of any dispute between parties it shall be referred to the jurisdiction of the English courts only and any actions shall be heard in the court for the area in which the property is located. Any disputes arising between us, if not mutually resolved, can be referred to a single arbitrator agreed, or in the default of such agreement, to the President for the time being of the Law Society or Institute of Arbitrators. In either case, such arbitration would be subject to the provisions of the Arbitration Act of 1996 or any statutory modification thereof for the time being in force. All parties will contribute equally to the cost of Arbitration.

These terms and conditions supersede any previous issues.
